It appears you are not thinking correctly again if you equate that to my question.

The article does not refer to it as a "hate crime". It says they have been arrested on suspicion of a public order offence in connection with a model of Grenfell Tower being burned on a bonfire. No mention of "hate crime".

So, perhaps nothing to do with what I asked.
As usual you make no attempt to answer my specific question.

Do you think they should be jailed for a distasteful bonfire and video?
If so, the prisons are going to be full of stupid people soon.

The video with sound track was put out on Social Media ( Youtube etc) with a purpose to stir up racial hatred.

Hate Crime: A crime where hatred of a protected characteristic is an aggravating factor. Potential hate crimes may extend beyond protected characteristics. example:

John punched Avril, because she is fat and john hates fat people. - Asault + hate crime.

John punched Avril who is fat, because she is an annoying bint. Not hate crime.

John was rude to Avril because she is fat and john hates fat people. - hate incident.

On the public order offence. It’s a stretch but might stick. Unlikely to be agrivated by hate as there was no specific characteristic attacked.
