Spot on. Borris would have been sunning himself in Greece not bothering with all the petty details. Starmy to his credit has made sure (through the appropriate channels of course) that the courts and CPS got their finger out

I never commented about the charge sticking or not. I commented about the charge. It mentioned hate !

You were trying to read too much into it.

She has been charged, that's all I wanted to see. Up to the courts to decide, not you.

Are "Inciting racial hatred online" and "Publishing written material intended to stir racial hatred" actually the same offence? If so, the reporting is very confusing. Maybe MBK will know?

I have been on GD a relatively short time, but I've never seen anything explicit calling for killing or violence against Jews. So I am thinking that if there ever was anything, it was at least two years ago. I have, however, been shocked by several such postings by people on the other side of the discussion (I don't mean by you!).

Like mottie, I do very little to try and hide behind a cloak of anonymity, my town of residence and even photographs of myself have appeared on here.

Can you claim the same?

You've certainly seen numerous posts comparing jews to nazis which constitute a race hate crime, the deleted posts by doubtfire or it's previous incarnation were along the lines of 'the jews had it coming' following the October 7 pogrom.

It's quite usual for threads to be locked when things get heated, it's unusual for entire threads to be deleted, I assume the site owners recognised that there were a number of posts putting the site itself in dangerous legal territory.

The Israel argument is a complicated one and has implications worldwide, not least in this country. I've always made my position clear in that I'm no fan of Netanyahu and I believe the settlement programme in the West Bank is illegal and should be reversed.

Make no mistake though, if the west bank was restored to it's pre 1967 borders and a two state solution agreed tomorrow, Iran still wouldn't rest until the Jews are driven into the sea.

It's just the way it is.
 
I was suggesting that a decent lawyer could defeat the argument that the motive was hate.

Her defence is she was relying on fake news.
Unless the prosecution can establish a hate motive to the necessary level of the charging standard, I can’t see it sticking. That is not to say there is no offence, there clearly is.

If you look at other prosecutions for the same offence, it has been necessary to show a pattern and sustained hatred.

But she might just plead guilty.

Interestingly, in the case of Tyler Kay for the same offence, his original post actually quotes her post and adds the hashtag #standwithlucyconnolly. He then goes on to make several other posts. He got four years but with 20% off for admitting some facts.

Obviously, Lucy Connolly only made the one post. But if it is proven that she actually encouraged others in some way, does that make it worse?

The anonymity of the injured party is all part of the process.
It's one of the reasons why I guard my personal data. It saves any reliance on the site Admin to furnish the details of the defamer, and time and money in pursuing a defamation claim.
Unfortunately it wouldn't be necessary if the typical defamers didn't make unproven and unprovable accusations.
