Tail-gating is reprehensible. Colliding into the back of another vehicle is the tail-gaiters' fault. Ask any insurance company.
If the driver thinks he saw something and brakes hard (brake check in action), that is hardly his fault if he gets hit from behind. The insurance company would rather payout for a vehicle bump than a potential pedestrian being run over. Ask any insurance company
 
Unless they have dash cameras - then you are screwed. You might even get reported for insurance fraud as well as dangerous driving.

Its pretty obvious to spot a brake checker.

Correct. That could be a street you wish to turn into, or a child aimlessly skipping along the edge of the footpath. Brake check my arse.

Rubbish, it changes nothing if they are too close to your bumper to react. It doesn't matter how big the gap is in front of you, if they are too close to react behind.

Just admit that you do not understand, rather than keep arguing about your (mis)comprehension.
