That’s lawyer speak. These are guidelines. You will see similar language on every topic.
 
I know. The point being, is it just your luck if you are prosecuted or not? Maybe it depends who was at the scene, or who was on duty at the CPS that day.

Is there any consistency? Who knows.
 
You said prosecutions were based on certain criteria. Seems like a fair bit of luck is also involved. All facilitators just aren't being prosecuted.
 
both can be true. If they catch you at the helm, I think you will get prosecuted. Unless you have done a FOI you won’t know how many are on remand for s24/25. The policy has only just started.
 
I don’t work for the CPS. And neither of you have any clue.

Perhaps it’s a better deterrent. Just like speeding, you never know if there is a camera around the corner.
 
it may be luck that you get arrested. It's not luck that you get prosecuted.
