Given a decent financial package with perks I would take the job and
I would decide :cool:

The jury make the decision of guilt, level of guilt, or innocence. The judge decides on the penalty to be paid, always, based upon sentencing guidelines.

WHO makes the decision? I cannot make the question any simpler, even for you.

Just to make it CLEAR CUT for you. Ive never said they are not clear cut cases. Ive asked who makes the legal decision that they are ?

I've never claimed anything of the sort. I've simply asked " WHO makes the decision of whether its clear cut, or not" ?

Feel free to answer, ask an adult if you need help to understand.
 
In America I would guess it's extra staffing costs. Higher security, suicide watch. In the UK I believe the sentence was carried out more quickly. But I haven't actually checked that!
Back to America, the death is more expensive because....
Most defendents can't afford their own Attorney, as the trial involves capital punishment two lawyers and a prosecutor are appointed at a cost to the public.
Capital Punishment trials last generally 4 times longer than non capital, for obvious reasons. Jury Selection is long winded, most death row prisoners are kept in solitary confinement in a special facility with more security.

When the evidence is beyond all reasonable doubt then Capital Punishment should be employed, taking the accused out of the court room into a van and straight to the electric chair, firing squad, lethal injection.

Not kept on death row for years making appeals and waiting for the law to change.

Nor that, threatened with long prison terms / death penalty, criminals increasingly opted to "leave no witnesses" i.e. become more likely to commit murder.

simple cut down cost march to back court house and carry out the sentence
 
of course its a sentencing matter thats why its called a death sentence.
But there could also be a case for no need for trial at all someone filmed cutting someones head off why bother wasting money
Agreed the Judge should have the final say, if he convinced beyond all doubt kill the Barstuaward
