The point I was making is currently people are getting longer sentences for sec 18/19 offences than robbery while in possession of a knife.

you may need to read up on what incitement to riot actually is. You will find it is not posting stupid racist tweets, saying you don't care if people do xyz.
Ok go look at various cases associated with the riots and note the sentences set by a judge who of course doesn;t work to any fixed rules / laws and makes them up in their head on a case by case basis. Your opinion doesn't amount to anything at all. The CPS's view does. They set the charge.

So in the land of the blind the one eyed is king but tbh few would be bothered to go into the actual legal aspects involved in a certain charge - that's what the CPS is for.

Right up to the point when it was thrown back atcha, then you started flailing and deflecting like you always do.

Of course a judge follows rules. Otherwise there are grounds for appeal. It’s why we have sentencing guidelines and minimum and max sentences.

You have invented a scenario of being guilty of causing a riot and are now trying to fit it in to the offence of rioting.

A police officer assaults an innocent black man due to mistaken identity, the outrage causes a riot.

A politician makes a provocative speech which triggers a protest. The protest turns in to a riot.

A journalist incorrectly reports on a story which causes public anger which turns in to a riot.

All 3 have caused a riot. None are guilty of sec 1 public order - rioting.
