Do you think you should go to prison for longer if you rob a convenience store armed with a knife
Is robbery with a knife punishable the same as robbery without a weapon?I would have thought “rob” is obviously Robbery. Section 8 of the theft act.
Nope. Not that one.Section 1 of the Public Order Act 1986 (POA 1986) creates the offence of riot.
It depends. Is robbery with a knife punishable the same as robbery without a weapon?
So why do you always expect yes or no, but never give that answer yourself. It depends.
Sec 18 or sec 19. Public order act.Which offence did you have in mind for this?
The point I was making is currently people are getting longer sentences for sec 18/19 offences than robbery while in possession of a knife. So why do you always expect yes or no, but never give that answer yourself.
Do you think it makes you look clever by asking closed questions, or can you not think of other options?
So yes, or no to his question, as you expect from others. The point I was making is currently people are getting longer sentences for sec 18/19 offences than robbery while in possession of a knife.
And that is quite clearly nuts.
Ok go look at various cases associated with the riots and note the sentences set by a judge who of course doesn;t work to any fixed rules / laws and makes them up in their head on a case by case basis. Your opinion doesn't amount to anything at all. The CPS's view does. They set the charge.you may need to read up on what incitement to riot actually is. You will find it is not posting stupid racist tweets, saying you don't care if people do xyz.
Which one?Sec 18 or sec 19. Public order act.
Sorry, your argument is dead. Too ambiguous. I retract my earlier yes/no answer, until you can be more specific. You do understand it's a relevant part of sentencing don't you?It depends.
Right up to the point when it was thrown back atcha, then you started flailing and deflecting like you always do.The point I was making is currently people are getting longer sentences for sec 18/19 offences than robbery while in possession of a knife.
Yep, that one (amendments section).Nope. Not that one.
Of course a judge follows rules. Otherwise there are grounds for appeal. It’s why we have sentencing guidelines and minimum and max sentences.Ok go look at various cases associated with the riots and note the sentences set by a judge who of course doesn;t work to any fixed rules / laws and makes them up in their head on a case by case basis. So in the land of the blind the one eyed is king but tbh few would be bothered to go into the actual legal aspects involved in a certain charge - that's what the CPS is for.
You have invented a scenario of being guilty of causing a riot and are now trying to fit it in to the offence of rioting.Yep, that one (amendments section).
Sec 1. Public order act. (part 1 'New offences')
