Angela Rayner


Labour's Angela Rayner was forced to flee out the back door of a pub this afternoon, after a campaign event was hijacked by tax protestors.

Ms Rayner was visiting Teesside with Labour's Shadow Chancellor Rachel Reeves when the campaign stunt disrupted their plans.

Walking down Yarm highstreet, Ms Rayner was seen hiding under an umbrella as activists wearing 'Tax inspector' high-vis vests unveiled a giant banner reading: "Angela Rayner: Tax dodger?"
Those 'protestors' seemed well prepared. Did I hear the word stunt....

The issue is very straight forward. Either AR or her husband will have a liability for CGT for the period they were married up to 2015 when her house was sold.

If AR's legal advice is correct and it isn't her, then it must be her husband.

Exactly. It is a matter of fact. For the period from when they were married up until when she sold up, either AR's house was the main home or her husband's was. Contrary to what MBK has been saying, their living arrangements during that period are very important.

remember it is not "main" home that is the issue.. its the fact that she is married and can only have one shared with her husband.

Surely, the "main" home is absolutely the issue. It is either her house or her husband's house. It doesn't matter whether one "moved in" with the other. It was you who kept bringing that up, not me.

S222(6) TCGA92 sets out that spouses or civil partners .... can only have one main residence between them for the purpose of private residence relief.

That is possible, but I think unlikely, because she claims to have had no knowledge of the CGT rules about two homes when she sold.

If that is the case, I believe it would be a matter of fact.


Where a notice is not made, or an invalid notice is made, the residence which attracts relief is the dwelling-house which is the main residence as a matter of fact.

They had 2 years to do this. I think she might have mentioned it, had she done it.

Doesn’t matter if HMRC take no action public opinion (based on a poll) says 3/4 say she should publish the advice she took and come clean.
